The lawsuit was filed by Sergio Rey, the new Acting Director of Lotto.com. According to the complaint, the commission had previously told lawmakers that it lacked authority to regulate courier services. Lotto.com is now challenging the proposed ban, describing it as a reversal that violates established procedures.

The company points out that the commission announced its intention to ban couriers in February and simultaneously seized terminals from courier services, without following the required 30-day notice period. Lotto.com also claims that the commission had ongoing communication with its team, which it says further complicates the agency’s sudden policy change.

Adding to the pushback, the Coalition of Texas Lottery Couriers — a group formed in 2025 to represent Lotto.com and other services — issued a statement calling for a reset. “It is time to reconsider the agency’s politically motivated decisions regarding lottery couriers and restart good faith collaboration between our companies and fresh leadership at the TLC,” the statement said.

The legal fight comes amid broader political and legal tensions. Lawmakers raised concerns earlier this year about the potential for money laundering and large-scale ticket purchases through courier services. Following these hearings, the Texas Lottery Commission proposed banning the operations altogether.

Meanwhile, the commission itself faces investigations by both the Texas attorney general’s office and the Texas Rangers. Lt. Gov. Dan Patrick has made banning couriers a priority, and the state Senate passed a bill to criminalize courier operations in February with full support.
