FanDuel Faces Lawsuit for Alleged Privacy Breach with TikTok Software

A lawsuit filed on July 30 in the US District Court for the Central District of California claims that FanDuel is being sued for allegedly using privacy-invading software. FanDuel is accused in the case of deploying a tracking technique that jeopardizes user privacy.

According to reports, TikTok’s software tracks users’ online actions and compares them to the company’s database through the use of fingerprinting technology. This implies that even if individuals chose to remain anonymous, FanDuel could still keep an eye on them. According to the complaint, this tracking occurs automatically as soon as a visitor reaches the FanDuel website, even before they have an opportunity to agree to the use of cookies.

The lawsuit contends that this practice breaches California’s Trap and Trace Law, which forbids the use of devices or methods that capture electronic data without consent or a court order.

Lack of Transparency and Legal Consequences

Adding to the controversy, the complaint alleges that FanDuel failed to inform users about the use of this software. The lawsuit claims that users were not made aware that their information might be shared with the Chinese government for identification purposes.

Courtney Mitchener, the lead plaintiff, aims to represent a class action of Californians affected by these alleged privacy violations. Mitchener is represented by Tauler Smith, a Los Angeles-based litigator with expertise in complex business disputes.

The lawsuit seeks statutory damages in line with California law and requests an injunction to halt the use of the contested software. At this time, Flutter Entertainment, FanDuel’s parent company, has not issued a public response to the allegations.

This lawsuit is not FanDuel’s first encounter with legal trouble. Just a month ago, the company faced a $2,000 fine for accepting bets on pre-recorded fights. Additionally, New Jersey gambling regulators required FanDuel to pay out over $230,000 in winnings.
