Aviator LLC and Flutter Settle Trademark Dispute, Forge Global Partnership

A high-profile trademark and copyright litigation between Aviator LLC and Flutter has come to a conclusion with a settlement, ending a huge legal issue. The two businesses now have a long-term collaboration as a result of the lawsuit, which was pending in the Georgian Court of the First Instance. Aviator-branded games can now be distributed by Flutter on all of its platforms worldwide.

Settlement and Future Collaboration

The dispute originated when Aviator LLC, owned by Teimuraz Ugulava, former operator of Adjarabet, accused Flutter of infringing on its intellectual property. The claim centered around the popular Aviator crash game, which Aviator LLC argued Flutter had been offering without authorization.

In August 2023, the court ruled that Flutter must pay €330 million ($342.5 million) in damages. However, the penalty was viewed by some, including a source close to NEXT.io, as disproportionate to the gaming industry’s financial context.

With the settlement now in place, Flutter has acknowledged Aviator LLC’s rights to the Aviator trademark and its signature airplane image. This resolution effectively ends the legal battle between the two companies.

Nikoloz Gogilidze, the legal representative for Aviator LLC, confirmed the new agreement. He stated, “Parties agreed on long-term cooperation which involves the integration of Aviator LLC’s or its affiliates’ games on Flutter’s platforms globally.” While the financial terms of the deal remain confidential, both sides have agreed to work closely moving forward.

Despite settling with Flutter, Aviator LLC’s legal disputes are far from over. The company is still engaged in litigation with Spribe, the developer behind the Aviator crash game. Aviator LLC has filed claims against Spribe in various jurisdictions, including the European Union Intellectual Property Office and the UK High Court, alleging unlawful use of its trademarked images.

Gogilidze reaffirmed Aviator LLC’s commitment to pursuing its case against Spribe, promising a formal update on the proceedings in the near future.
