Harry Yeremian, a former employee of MGM Grand Detroit, was fired for refusing to get the COVID-19 vaccine, but a federal jury decided in his favor and awarded him $133,000. Yeremian, a 56-year-old Canton Catholic, refused the immunization, citing his religious convictions. His legal team contended that his case was a noteworthy instance of employment discrimination because he was the only worker sacked for refusing to get a vaccine.
Back in 2021, MGM Grand Detroit implemented a strict vaccine mandate, prioritizing vaccinated employees to ensure workplace safety. However, Yeremian’s refusal to comply led to his termination, despite the casino’s acknowledgment of his religious objection. In a statement to Yeremian, the casino claimed his unvaccinated status posed “significant risks to the health and safety of guests, coworkers, and himself.”
Interestingly, not all MGM employees were required to get vaccinated. Around 20% of the workforce, primarily unionized staff protected by the National Labor Relations Act, remained unvaccinated. Yeremian, however, was singled out, prompting him to file a lawsuit in 2022.
Compensation and Broader Implications
The jury awarded Yeremian $33,000 in backpay and an additional $100,000 in damages. Despite this victory, the compensation appears modest compared to his $120,000 annual salary at the casino. Yeremian’s lawyers emphasized the case’s broader implications, stating: “The jury’s verdict today tells MGM that religious discrimination has no place in America and affirms each person’s right to religious freedom.”
The decision brings to light persistent conflicts between employers and workers regarding vaccination requirements, especially in sectors like gaming and hospitality. MGM Grand Detroit v. Yeremian serves as a reminder of the intricacies of individual rights and employment regulations.
The court’s ruling emphasizes the significance of striking a balance between public health measures and respect for individual and religious views, even though MGM Grand Detroit insisted that its actions were driven by health considerations.
