Brazil has announced new regulations limiting the transfer of player data and funds to licensed operators as the country’s regulated sports betting and iGaming industries prepare to start in a little more than a month. A key component of the future regulatory framework that will transform Brazil’s gaming business is the revised guidelines, which were published in SPA/MF Ordinance No. 1,857 by the country’s Official Gazette of the Union.
Key Changes for Players and Operators
Under the new ordinance, players have until March 2025 to withdraw funds from unlicensed operators. Additionally, from March 31, access to player accounts with unlicensed operators will be restricted. To facilitate the transition to licensed platforms, bettors will be required to verify their identity using facial recognition technology. Furthermore, players must consent to the migration of their personal data and register a bank account approved by Brazil’s Central Bank to authorize the transfer.
For operators looking to assist their customers in transferring data to a licensed platform, they must submit a formal request to the Secretaria de Acompanhamento e Planejamento (SPA) by December 13. Only operators with an approved general license will be allowed to submit these requests. Once submitted, there will be a 15-day waiting period for approval confirmation.
Brazil’s regulatory framework has been gaining momentum in the lead-up to the opening of the sports betting and iGaming markets. Recently, the Ministry of Sports initiated a probe into irregular gambling promotions on YouTube. Meanwhile, the Ministry of Justice imposed a last-minute order on 17 betting companies. In addition, the IBJR (Instituto Brasileiro de Jogo Responsável) has published a new manifesto outlining gaming industry standards.
Approximately 93 operators are still awaiting confirmation of their license approval in spite of these developments. Although Brazil has experienced many obstacles on its route to regulation, these most recent developments show that the nation is making great strides in the direction of a more secure and regulated gambling industry.
