Wynn Resorts Faces Lawsuit Over Negligence and Unjust Enrichment

James Bay Resources, a Canadian mining business, and its president, Stephen Shefsky, have launched a lawsuit against Wynn Resorts, putting the massive casino operator under legal watch. The complaint was filed in Ontario and claims that Wynn Resorts engaged in unfair enrichment and carelessness with regard to gaming operations involving former decathlete David Bunevacz.

Between January 2018 and June 2019, the plaintiffs assert that Bunevacz lost about $3.8 million at the Wynn Las Vegas. A portion of these monies were purportedly obtained through corporate and personal loans given by James Bay Resources and Shefsky.

Misuse of Loans and Wynn’s Alleged Oversight

According to the lawsuit, Shefsky and his company provided Bunevacz with loans totaling $4.6 million, intended strictly for business purposes. However, the plaintiffs allege that Bunevacz diverted these funds for personal gambling at Wynn Las Vegas. Despite this, the lawsuit claims the casino failed to detect or report the suspicious transactions in compliance with federal regulations, which require monitoring of transactions over $10,000.

Additionally, the complaint notes that Wynn did not investigate Bunevacz’s criminal history, which included tax liens and civil lawsuits, nor did they address his status as a “problem gambler.” The plaintiffs argue that had Wynn followed its legal obligations, they would have identified the questionable nature of Bunevacz’s funds.

Bunevacz was convicted in 2022 of cheating investors out of over $45 million and received a 17 and a half-year prison sentence. According to the lawsuit, Wynn Resorts ought to have been aware of Bunevacz’s tendencies toward gambling and restricted his actions. In addition, it charges that the business ignored warning signs and “willingly and blindly engaged in transactions” with him.
