France’s Gambling Regulator and Advertising Watchdog Forge Strong Partnership to Tackle Gambling Advertising

L’Autorité Nationale des Jeux (ANJ) and L’Autorité de Régulation Professionnelle de la Publicité (ARPP) have joined forces in a breakthrough collaboration agreement to improve regulatory efficiency and address the rising issue of gambling advertising in France. This agreement is a big step forward in guaranteeing responsible advertising practices and effective control of the country’s gambling industry. The two authorities intend to collaborate through the formal development of an information sharing and exchange framework, boosting cooperation across critical sectors for a coordinated strategy to preventing excessive gaming advertising.

The new agreement establishes clear guidelines for ANJ and ARPP’s respective functions. ANJ will now ask gaming operators to disclose their marketing and advertising strategy for approval. In turn, ANJ will inform ARPP of its intention to reject an operator’s marketing plan. This faster approach will aid in ensuring that advertising campaigns adhere to appropriate standards while preventing an overabundance of advertisements during major athletic events such as the Rugby World Cup and the highly anticipated 2024 Olympics.

The agreement offers a formal structure for ANJ and ARPP to exchange information. Subject to confidentiality agreements, the latter can request ANJ’s advice on an operator’s proposal’s conformity with advertising requirements. Furthermore, ARPP will swiftly notify ANJ if a customer lodges a complaint with le Jury de Déontologie Publicitaire (JEP), an independent organization responsible for resolving consumer advertising disputes.

The agreement also requires ARPP and ANJ to hold an annual conference to explore current advertising trends and novel business methods. During these meetings, authorities will identify areas that require additional cooperation and look into chances to develop new products and techniques to further regulate gaming advertising.

ANJ released a thorough set of advertising rules for gambling firms early this year in a preemptive step. Ads that trivialize gambling, distort the possibilities of winning, or connect gambling with social status development or an alternative to meaningful employment are prohibited under these amended criteria. ANJ hopes to establish a safer gambling environment while safeguarding consumers from fraudulent advertising tactics by introducing these stronger laws.

The fruitful collaboration between ANJ and ARPP has already resulted in the introduction of the Responsible Influencer Certificate’s gaming module. This certification allows social media influencers to demonstrate their ethical practices, which helps to safeguard consumers and promote responsible gaming.
