India Supreme Court will hear the final constitutional challenge to the Promotion and Regulation of Online Gaming Act, 2025, placing the nationwide online real money gaming ban before the highest court. The law took effect on May 1, 2026 and prohibits online money games regardless of whether skill or chance decides the outcome.

The hearing brings two competing problems before Supreme Court of India.
One group challenges the law itself. Petitions question whether Parliament can impose one nationwide prohibition covering both gambling products and games traditionally treated as skill based activities. Dr. K A Paul is among the petitioners involved in the wider litigation over online betting and gaming regulation.
At the same time, Centre for Accountability and Systemic Change, or CASC, wants stronger enforcement against betting and gambling platforms that allegedly present products as social gaming or esports.
Advocate Virag Gupta told the court that details covering roughly 2,000 gaming applications had already gone to the government and the bench. He also said authorities had not filed the response requested under an earlier Supreme Court direction from October 2025.
Former Uttar Pradesh DGP Vikram Singh and Shourya Tiwari represent CASC in the case.
The legal divide matters because the Promotion and Regulation of Online Gaming Act does more than prohibit operators from offering online money games. Sections of the law also ban advertising and payment transfers connected with such products and give authorities blocking and enforcement powers.
India previously relied heavily on state gambling laws and court decisions separating games of skill from games of chance. The 2025 Act replaced much of that fragmented approach with a national framework for online money gaming, while creating separate treatment for esports and social games.
