As a result, Bally\u2019s had to refund investor deposits.<em> \u201cIt was disappointing for the SEC to not respond,\u201d<\/em> said Bally\u2019s Chairman Soo Kim. <em>\u201cWe\u2019re going to come back. We\u2019re going to update our financials and resubmit.\u201d<\/em><\/p>\n<p data-start=\"905\" data-end=\"1222\">Originally launched in January, the IPO allowed women and minority investors to purchase shares ranging from $250 to $25,000. Bally\u2019s now plans to update its financials and relaunch the offering in March. The SEC has not commented on the situation, following its policy of not discussing individual company filings.<\/p>\n<h2 data-start=\"1224\" data-end=\"1272\">Legal and Construction Challenges Persist<\/h2>\n<p data-start=\"1273\" data-end=\"1585\">The IPO\u2019s investor restrictions are still being contested in a court lawsuit. The action sought an injunction to halt the IPO and was launched by opponents who claimed that white men were being discriminated against. A federal judge in Chicago, however, turned down the request, allowing Bally\u2019s to proceed while the larger case is still pending.<\/p>\n<p data-start=\"1587\" data-end=\"1875\">Despite the IPO setback, Bally\u2019s still must secure 25% minority ownership.
