The case asks an Amsterdam court to examine whether Meta has met obligations under the EU Digital Services Act.<\/p>\n<hr>\n<p><strong>Good to know<\/strong><\/p>\n<ul>\n<li>VNLOK says more than 90% of gambling ads on Meta platforms come from unlicensed operators.<\/li>\n<li>Meta removed 11% of flagged unlicensed ads in May and 15% in June.<\/li>\n<li>A separate parliamentary proposal would give Kansspelautoriteit clearer powers to fine platforms that repeatedly leave unlicensed gambling ads online.<\/li>\n<\/ul>\n<hr>\n<h2><strong>VNLOK Takes Meta Advertising Dispute to Court<\/strong><\/h2>\n<p>The lawsuit follows months of research into gambling advertising across Facebook and Instagram. VNLOK first announced legal action and filed a complaint with the European Commission in June.<\/p>\n<p>VNLOK chairman Bj\u00f6rn Fuchs said:<\/p>\n<p><em>\u201cWe have repeatedly pointed out the scale of the problem to Meta and asked them to cooperate structurally in finding a solution. That has yielded insufficient results. Therefore, we are now submitting the case to the Dutch courts.\u201d<\/em><\/p>\n<p>Recent VNLOK data found that 96.5% of gambling advertisements examined in May came from operators without a Dutch license. The share reached 93.7% in June. Meta removed 11% of the identified ads in May and 15% in June.<\/p>\n<p>The numbers build on earlier findings. During the final quarter of 2025, VNLOK counted 61,717 gambling ads in October, 84,493 in November and 67,732 in December. More than 95% in every month promoted unlicensed operators, while Meta removed between 3% and 5.2%.<\/p>\n<p>VNLOK argues that removal after publication cannot keep pace because many advertisements disappear and return under different identities. In May, 76% of unlicensed gambling ads remained online for less than one day. In June, the figure was 65%.<\/p>\n<h2><strong>Digital Services Act Becomes Central to Case<\/strong><\/h2>\n<p>VNLOK wants the court to determine whether Meta complies with the Digital Services Act. EU rules require online platforms to provide systems for reporting unlicensed content and address risks linked to content distributed through their services. Dutch government responses have also confirmed that the DSA applies to reporting systems for unlicensed gambling content.<\/p>\n<p>The legal action arrives while Dutch lawmakers consider giving Kansspelautoriteit more specific powers over online platforms.<\/p>\n<p>A motion filed by VVD MP Bart Bikkers and other lawmakers on September 23 asks the government to amend the Gambling Act so platforms can face a fine or penalty payment when they repeatedly display unlicensed gambling advertising after a KSA removal request. A House of Representatives vote was scheduled for September 29.<\/p>\n<p>The motion states that KSA sends thousands of removal requests to Meta each month but says current law lacks a specific rule covering repeated publication after those notices.<\/p>\n<p>VNLOK argues that the regulator already has tools available and should use them more widely.<\/p>\n<p>Fuchs said:<\/p>\n<p><em>\u201cThe regulator must hold parties that play a role in reaching Dutch consumers with illegal offerings more emphatically accountable for their responsibility. No legislative amendment is needed for this; the regulator already has those legal options.\u201d<\/em><\/p>\n<p>Dutch government answers earlier in 2026 said KSA can take enforcement action when social media platforms violate the Gambling Act, including issuing binding instructions to remove certain content.<\/p>\n<p>The dispute also extends beyond Meta. VNLOK says unlicensed operators can return through another advertising channel after removal from one platform.<\/p>\n<p>Fuchs said:<\/p>\n<p><em>\u201cMeta is currently the party we are taking legal action against, but the problem is broader. If an illegal provider is removed via one platform, the same provider pops up again via another channel. Then we are constantly playing catch-up.
