However, the 18th Federal Civil Court of the Federal District later suspended registration No. 501759803 and barred Spribe from claiming exclusivity until a final ruling.<\/p>\n<p>Article 296 of the Brazilian Code of Civil Procedure allows a court to revise or cancel interim relief when the underlying circumstances change. The Pernambuco ruling applied that principle rather than deciding final ownership of the AVIATOR trademark.<\/p>\n<p>Aviator Studio Brasil brought the federal invalidation action and submitted evidence that the brand originated in Georgia in 2016 and gained registration there in 2018, before Spribe secured Brazilian protection. Brazilian judges also considered Georgian rulings that invalidated Spribe registrations and supported the original trademark owner.<\/p>\n<p>The latest order reverses an earlier Pernambuco decision involving Betnacional, which had required the operator to stop using AVIATOR branding while Spribe relied on its Brazilian registration.<\/p>\n<p>Spribe also faces a separate Brazilian inquiry. In June, the Public Prosecutor Office of the Federal District and Territories opened an investigation into alleged misleading advertising, unfair commercial practices and a possible gap between advertised and actual RTP.
